Terms of Service

1. Definitions

• “Hexis”, “we”, “us”, or “our” means the Hexis service, operated by Arachnida Apps.
• “You” means the person using Hexis under their Arachnida Apps account.
• “Content” means anything you record, upload, or generate in Hexis, including results, speculations, profiles, and nicknames.
• “Speculation” means your own impressions or estimated personality bands about yourself or another person.

2. Eligibility

You must be at least 16 years old (and at least the age of digital consent in your jurisdiction) and able to form a binding contract. If you are a minor where you live, a parent or legal guardian must review and agree to these Terms on your behalf. You must use Hexis only through a valid Arachnida Apps account and only as permitted by these Terms and applicable law.

3. Your account

You access Hexis by signing in with Arachnida Apps; we never see or store your password. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly of any unauthorized use. You may not share your account, impersonate anyone, or access data that is not yours.

4. What Hexis is — and isn’t

Hexis is an informational, self‑reflection tool. It helps you record HEXACO results (including an on‑site, public‑domain IPIP‑HEXACO questionnaire and imported HEXACO‑PI‑R results) and compare your impressions of people against their self‑report.

Hexis is not a psychological, clinical, medical, forensic, or diagnostic instrument, and it does not provide medical, psychological, legal, employment, financial, or other professional advice. No professional‑client relationship is created by your use of Hexis. Personality bands, percentiles, compounds, and similarity figures are descriptive statistical estimates — not judgements of worth, ability, character, or fitness — and may be inaccurate. You must not rely on Hexis, and must not use it, to make decisions about employment, hiring, insurance, credit, education, housing, health, safety, legal matters, or anything else of consequence about yourself or anyone else. Such use may also violate the law. The HEXACO‑PI‑R questionnaire is administered by its authors at hexaco.org.

5. Acceptable use

You agree that you will not, and will not attempt to:

• use Hexis unlawfully, or to harass, defame, stalk, threaten, dox, or harm anyone;
• record, upload, or share information about another person that you have no lawful basis to hold, or that infringes their privacy or other rights;
• attempt to identify, re‑identify, or unmask any user who has chosen to remain anonymous;
• access, probe, or interfere with accounts, data, or systems that are not yours, or circumvent any access control, visibility setting, or security measure;
• scrape, crawl, harvest, or use bots or automated means to access Hexis or collect data from it;
• reverse engineer, decompile, or attempt to derive source code, except to the extent this restriction is prohibited by law;
• introduce malware, overload or disrupt the service, or use it to build or train a competing product or dataset;
• misrepresent your affiliation with Hexis or remove any proprietary notices.

6. Information you record about other people

Hexis lets you keep private speculations and profiles about people you know. You alone decide what to record, and you are solely responsible for it. You represent and warrant that you have a lawful basis to collect and keep any information you record about another person, that doing so complies with applicable privacy and data‑protection laws, and that you will not use Hexis to make or support consequential decisions about them. With respect to that information you act as its controller; Hexis merely stores and processes it on your instruction so you can use the service. We may remove information about a person at their request or where we believe these Terms or the law have been violated.

7. Your Content & license

You retain ownership of your Content. To operate Hexis, you grant us a worldwide, non‑exclusive, royalty‑free license to host, store, process, transmit, and display your Content solely to provide and maintain the service for you and the people you have chosen to share it with. This license ends when you delete the Content or your account, except for residual copies in routine backups that age out on our normal cycle and to the extent we must retain something to comply with law. You are responsible for the legality of your Content and for keeping your own copies; use the export tool in Settings at any time.

8. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Hexis, Arachnida Apps, and their operator, contractors, and affiliates from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your Content, (b) your use of Hexis, (c) your violation of these Terms or any law, or (d) your collection, use, or sharing of information about another person. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us.

9. Intellectual property

The HEXACO model of personality and the HEXACO‑PI‑R are the work of Kibeom Lee and Michael C. Ashton; the HEXACO‑PI‑R is copyrighted by its authors. The IPIP item pool is in the public domain. Hexis is an independent tool and is not affiliated with, endorsed by, or sponsored by the authors of the HEXACO‑PI‑R, hexaco.org, or the IPIP. The Hexis and Arachnida Apps names, logos, software, and design are ours or our licensors’ and are protected by intellectual‑property laws; these Terms grant you no right to them beyond using the service as intended. All other trademarks belong to their respective owners.

10. Third‑party services

Hexis relies on third‑party services (including the Arachnida Apps sign‑in service, an email provider, your browser’s push service, and hosting infrastructure) described in our Privacy Policy. We are not responsible for third‑party services or any sites they link to, and your use of them may be subject to their own terms.

11. Disclaimers

HEXIS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that Hexis will be uninterrupted, secure, or error‑free, that results, percentiles, or comparisons are accurate, complete, or scientifically valid for any particular purpose, or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEXIS, ARACHNIDA APPS, AND THEIR OPERATOR AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, arising out of or related to your use of (or inability to use) Hexis, even if advised of the possibility. Our total aggregate liability for all claims relating to Hexis will not exceed the greater of the amount you paid us for the service in the twelve months before the claim or USD $100. These limits do not apply to liability that cannot be excluded or limited by law (such as, in some jurisdictions, liability for death or personal injury caused by negligence, or for fraud). Where law does not allow some of these limitations, they apply to the maximum extent permitted.

13. Suspension & termination

You may stop using Hexis and delete your data at any time from Settings, or delete your Arachnida account entirely. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms or the law, or to protect Hexis or its users. Sections that by their nature should survive termination (including Content responsibility, indemnification, disclaimers, limitation of liability, and governing law) will survive.

14. Changes to Hexis and to these Terms

We may add, change, or discontinue features at any time. We may also update these Terms; when we make a material change we will update the “last updated” date and ask you to accept the revised Terms before you continue using Hexis. Changes are not retroactive. Your continued use after a change takes effect means you accept it.

15. Governing law & venue

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict‑of‑laws rules. To the fullest extent permitted by law, you agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to Hexis or these Terms shall be the state and federal courts located in Louisiana, and you consent to personal jurisdiction there. Nothing in this section deprives you of the protection of mandatory consumer‑protection laws of the place where you live, or of your right to bring a qualifying claim in small‑claims court.

16. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Hexis. If any provision is held unenforceable, the rest remain in effect and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Headings are for convenience only.
